"Taken into Custody" Stephen Baskerville" Habeus Corpus. I'm not a legal expert, but the description at Wikipedia is well informed and informative. What strikes me as important is the constitutional language itself, "The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it." Because DV advocates have successfully politicized domestic abuse as a "public safety" issue, they have been able to dispense with the inconveniences of a Father who has not initiated a divorce action and who is being denied access to his kids. By closing Family Courts from public scrutiny, any Father who contests the actions of the Family Court can be deemed guilty of "rebellion" opening himself up to persecution by the government simply for wanting to see his kids.
Such is the FALSE argument of a closed Family Court that speedily dispenses with the inconvenience of judicial oversight by and for the people. The establishment of such laws that close Family Courts from the scrutiny of the public eye are the very laws that permit the unbridled tyrrany of fear to grip, choke, and kill the constitutional rights of the non-custodial parent.
